There is a belief that to resolve your taxes you must prepare for war with the IRS. While it is true the IRS will fight hard to collect their money, this does justify your preparing for war with them. If you had the money to go to war with the IRS, then you probably wouldn’t be in this position.  Preparing for war on one side only causes hostility on the other side.

The premise to fight the IRS tooth and nail for the best possible outcome is a marketing strategy used by many of national resolution firms seeking your business who want you to think there is going to be a vicious fight, that you need them as your gladiator, and at the end of that fight, you will only have to pay back pennies on the dollars. This tactic is used by many firms to justify outrageous fees.

The reality is that if you use the laws that protect your rights and apply for the repayment program that best fit your situation, you will be able to resolve your tax debt for the least amount possible - all without having to dawn your camouflage pants and your black face paint.

Many individuals think they need to find the best and highest-priced tax attorney or accountant to garner the best results. I can’t tell you how many times people have shared with me how they have spent thousands on fees with the promise of having to pay back only a small percentage of what is owed, only to later be told by the overpriced “expert” that they do not qualify for that program and to get ready to write a big check to the IRS. Just yesterday I heard the worst story yet. A taxpayer paid $20,000 to a so-called expert who only was able to get her payment broken up in monthly installments. (FYI- almost everyone qualifies for this payment program.) To make matters worse, the taxpayer discovered that one of the years she owed the IRS was not included in that payment plan and now the IRS was telling her she was out of compliance. You must maintain compliancy in order for the IRS to honor your repayment plan. Long-story short, the IRS demanded a payment right away for $5,000 (the delinquent amount for the year in question), and, if she paid it, she would then be in compliance and could keep her installment agreement. The taxpayer was under the impression from the accountant she hired she would be able to settle the whole outstanding tax bill for $5,000, which in reality was only one small payment of the many payments to the IRS.

The problem with this model is that the taxpayer in trouble is willing to pay an exorbitant fee to an “expert” if he/she thinks it will help him/her walk away from the majority of the tax bill. So of course that is what the “expert” will say. Otherwise they won’t collect their outrageous fee.

I will give the ‘expert’ credit for being an expert on how to collect fees but that’s about it.

Request An Offer-In-Compromise When You Don’t Qualify

This ties into the section above. With an Offer-In-Compromise, you will have the best results for paying back the least amount possible. However, only a fraction of those who apply are qualified for this program –something left out of the sales pitch by the experts. Not only are about 75% of the Offer-In-Compromise candidates rejected, but typically there is a 20% down payment when submitting this offer. This down payment is non-refundable - even if your offer is denied. With approximately 75% of all submitted offers being rejected and a 20% non-refundable down payment, it is worth double checking if you really qualify for this program.
